United Imaging, LLC makes no representations or warranties of any kind concerning the safety, suitability, vulnerability to viruses or system attacks, inaccuracies, typographical errors, or other potentially harmful components of this United Imaging Marketwise software. There are inherent dangers in the use of any software, and the user of the United Imaging software is solely responsible for determining whether this United Imaging Marketwise software is compatible with equipment and other software installed on equipment. The user of the United Imaging software is also solely responsible for the protection of your equipment and backup of your data, and United Imaging, LLC will not be liable for any damages suffered in connection with using or modifying this SOFTWARE PRODUCT.
In no event shall United Imaging, LLC be liable to any party for direct, indirect, special, incidental, or consequential damages, including lost profits, arising out of the use of the software and its documentation, even if United Imaging, LLC has been advised of the possibility of such damage. United Imaging, LLC specifically disclaims any warranties, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The software and accompanying documentation, if any, provided hereunder is provided “as is”. United Imaging, LLC has no obligation to provide maintenance, support, updates, enhancement, or modifications to this SOFTWARE PRODUCT.
United Imaging, LLC is not responsible for the exposure of patient images or other patient information protected under the HIPAA legislation. There are inherent risks in allowing remote or direct access to any computer system and database and you are solely responsible for the exposure and protection of your patient images and information made available to United Imaging, LLC through access of any kind.
By granting access to your system, your program, and database to United Imaging, LLC or any representative, employee, or contract employee of United Imaging, LLC, you agree to absolve United Imaging, LLC, its representatives, employees, or contract employees of any damage to any software or hardware on your system, loss of data contained or not contained in the United Imaging software program, or malfunction of any software or hardware on the system on which you have allowed access.
